These terms detail how Board of Trade Corporation (“BOTC”) processes your purchases and interactions through the seeyellow.com (the “Platform”). By processing your purchase through the Platform, you are agreeing to these terms.

BOTC is a manufacturer, wholesaler, and retailer of health and wellness products in the United States, the United Kingdom, Europe, Mexico, and South America. BOTC is a for profit enterprise legally authorized to transact business in the various jurisdictions comprising BOTC’s marketplace.

BOTC will collect data about your purchase transaction so that BOTC can process the payments, ship the products, and fulfill any warranty obligations. The sharing of your data is governed by BOTC’s privacy policy.

BOTC shall comply with all state and federal laws or any other applicable laws.

BOTC may, in its sole discretion, block, suspend, or refuse to fulfill any order BOTC deems to be fraudulent, abusive, or illegal. Accordingly, you are prohibited from doing any of the following:

1. Purchase from BOTC using unauthorized credit card, or illegally possessed payment methods,
2. Falsify your age at time or purchase,
3. Falsify your address at time of purchase;
4. Purchase products into a jurisdiction where the BOTC products are not lawful,
5. Intentionally interfere with or damage operation of the BOTC by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code;
6. Using the BOTC platform for any purpose that violates any law.

If you engage in any of the prohibited conduct listed above or otherwise violate any of these terms, your permission to use the BOTC platform may automatically be terminated. BOTC may suspend or revoke your access to and use of the BOTC services, if necessary to comply with legal requirements or to protect the rights or interests of BOTC or any third party.

All visual interfaces, graphics, design, compilation, information, computer code (including source code or object code), products, software, services, and all other elements of the services provided by BOTC are protected by United States copyright, trade dress, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws and are the property of BOTC or its subsidiaries or affiliated companies and/or third-party licensors. All trademarks, service marks, and trade names are proprietary to BOTC or its affiliates and/or third-party licensors.

Limited Product Warranty. The only Product warranty given by BOTC is the standard BOTC limited warranty to customers contained in the Terms and Conditions of Sale (the "Limited Warranty"). EXCEPT FOR THE LIMITED WARRANTY TO CUSTOMERS CONTAINED IN THE TERMS AND CONDITIONS OF SALE, BOTC MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, WRITTEN OR ORAL, ARISING BY LAW, OUT OF ANY COURSE OF DEALING OR PERFORMANCE, CUSTOM, INDUSTRY STANDARD OR OTHERWISE, AS TO ANY MATTER WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THE PRODUCTS, THE CONDITION, QUALITY, SAFETY, PERFORMANCE OR RESULTS OF THE PRODUCTS, THEIR MERCHANTABILITY OR THEIR FITNESS FOR ANY PARTICULAR PURPOSE, ALL OF WHICH ARE HEREBY EXPRESSLY DISCLAIMED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER BOTC NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OPERATING OR DELIVERING THE PRODUCTS WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER LEGAL THEORY, WHETHER OR NOT BOTC HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE WHERE SUCH DAMAGES RESULT FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE. YOU AGREE THAT THE AGGREGATE LIABILITY OF BOTC TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE FACE VALUE OF ALL PRODUCTS PROCESSED THROUGH THE PLATFORM IN THE 12 MONTHS PRECEDING SUCH CLAIM. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN BOTC AND YOU.

This rebate program, and these terms, are governed by the laws of the State of Delaware. You agree that any legal claim that you have in connection with these terms and the rebate will be brought exclusively in the courts located in Newcastle, Ohio, and you submit to the jurisdiction of those courts.
